TERMS & CONDITIONS
⁃ By entering the Promotion, you agree to be bound by these terms and conditions (these Terms and Conditions).
To enter the competition, the entry form HERE must be fully completed and submitted.
⁃ Entries must be made between 12pm on the 3rd of July 2023 & midnight on the 31st of August 2023 (the Promotion Period). Entries received after the Promotion Period will not be counted or accepted.
⁃ Entries received which are not submitted via the official entry method will not be accepted. For example, those that are submitted via email or telephone.
⁃ You can only enter this prize draw once. TOCA Social (The Promoter) and Another Way accept no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
WINNERS & PRIZES
⁃ There will be 1 winner.
⁃ The prize includes return flights to Sydney, Australia for 2 people, 2 tickets to Sydney F.C. for a game of the winner's choice during their stay and a week's stay in a 4-star hotel. Subject to availability.
⁃ Once the winner has been chosen, TOCA Social will put the winner in touch with Another Way to organise the prize. This will be organised via email.
⁃ The winner (and their guest) is responsible for paying all associated costs that are not specifically stated in Terms and Conditions, including (where applicable) transport, accommodation, food and beverage costs, spending money, insurance and all other incidentals.
⁃ The first prize winner and their guest are also personally responsible for any personal expenses and any VAT, national and/or local tax liabilities incurred in claiming or using the prize. If the first prize winner's companion is a minor (under the age of 18 years old), the minor must be accompanied by their parent or legal guardian if they are not the first prize winner.
⁃ Prizes are as stated and are non-exchangeable and non-transferable. There is no cash or other alternative to the prize in whole or in part.
⁃ By participating in the Promotion, participants agree that each prize is awarded on an "as is" basis, and that neither the Promoter nor any of its subsidiary or affiliated companies make any representations, guarantees or warranties of any nature with respect to any of the prizes.
⁃ In the event that, for reasons beyond the Promoter’s reasonable control the Promoter is unable to award any of the prizes as described in these Terms and Conditions, the Promoter reserves the right to award a prize(s) of a similar nature and an equivalent value, or at its sole discretion, the cash value of the prize if in its reasonable discretion it is appropriate to do so.
⁃ The prize cannot be used in conjunction with any other promotion or offers.
⁃ Contact information of the entrant cannot be changed once the entry form is complete and submitted.
Awarding the winner and runners-up and claiming of prize
⁃ The winner will be notified by email or using the other contact details provided to the Promoter within 5 business days after the end of the Promotion Period. All reasonable endeavours will be made to contact the winner and the runners-up prior to 8th September 2023.
⁃ The winner will be required to confirm acceptance of the applicable prize within two (5) working days of having been notified. If the winner has not claimed their respective prize by the date specified or if the winner refuses or is unable to provide an eligible postal address or email address for receipt of their prize, that person has forfeited their prize and the Promoter reserves the right to award the prize to another entrant.
⁃ The prize will be delivered within a reasonable time. For the avoidance of doubt, the Promoter will put the winner in touch with Another Way to organise their prize by 30th September, but the Promoter is not responsible or liable if the winner does not receive their prize.
⁃ The prize may not be claimed by a third party on your behalf.
⁃ The Promoter does not accept any responsibility if the winner is not able to take up their respective prize.
⁃ TOCA Social is not responsible for the administration of this promotion or the fulfilment of any of the prizes.
Data Protection and Publicity
⁃ The Promoter will collect and process all participants' personal information in accordance with Data Protection Laws and the Promoter’s privacy policy available here: https://toca.social/privacy-policy.
⁃ For the purposes of these Terms and Conditions, Data Protection Laws means: (a) to the extent the UK GDPR (which has the meaning given to it in section 3(10) (as supplemented by section 205(4)) of the Data Protection Act 2018) applies, the law of the United Kingdom or of a part of the United Kingdom which relates to the protection of personal data; b) to the extent the EU GDPR (meaning the General Data Protection Regulation ((EU) 2016/679) applies, the law of the European Union or any member state of the European Union to which the party is subject, which relates to the protection of personal data. See also condition 4 of the ‘General’ section (below) in regards to announcements of winners.
⁃ Information provided by participants will only be used for the purpose of conducting this Promotion (including for prizes to be delivered)
⁃ By entering the promotion, participants will be able to opt in or out of receiving future promotional materials from the Promoter.
⁃ By entering this competition, participants agree to allow the free use of their names, photographs and their general location for publicity and news purposes if they are any of the winners of the Promotion. This includes making their name available on the Promoter's websites and social media platforms.
Ownership of competition entries and intellectual property rights
⁃ All competition entries and any accompanying material (if applicable) submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
⁃ By submitting your competition entry and any accompanying material, you agree to: (a) assign to the Promoter all your intellectual property rights with full title guarantee; and (b) waive all moral rights, in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
⁃ You agree that the Promoter may, but is not required to, make your entry available on its website (www.toca.social) and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials (if applicable), to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials (if applicable) for such purposes.
Limitation of liability (please read this carefully)
⁃ Entrants must not do anything illegal and/or dangerous and/or that would put themselves or others at any risk. You must comply with the terms and conditions in force at the Promotor’s venues when participating in the Striker challenge available here: https://toca.social/terms-of-use.
⁃ Insofar as permitted by law, save where the Promoter, it agents or distributor has been negligent, the Promoter, its agents or distributors will not in any circumstance be responsible for any damage, loss, personal injury or death resulting from participants' entry into the Promotion or whilst taking part in the promotion. Participants take part in the challenge at their own risk. Nothing in these Terms and Conditions shall in any way limit the Promoter's liability for death or personal injury caused by its negligence or the negligence of its employees, agents or distributors or that of their employees for any other matter where liability may not be limited as a matter of law. Your statutory rights are not affected.
General
⁃ The Promoter's decision is final and binding on the participants. No correspondence will be entered into with any participant, except for with the winners in which case limited correspondence may occur for the purpose of issuing the prizes.
⁃ If participants do not provide any of the mandatory information requested when participating in the Promotion, their entry will be void and will not count.
⁃ The Promoter reserves the right to require the participants to prove that they are eligible. If a winner is found to be ineligible, the Promoter reserves the right to award their prize to another participant.
⁃ The Promoter must either publish or make available information that indicates that a valid award of the prizes took place. To comply with this obligation the Promoter will send the surname of the prize winner to anyone who emails grace.brown@toca.social within one (1) month after the closing date stated in condition 4 of ‘Participation in the Promotion’ (above). If you object to your surname being published or made available, please contact the Promoter (by contacting Grace Brown at grace.brown@toca.social). In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
⁃ Unless otherwise stated in the promotional materials, this Promotion is in no way sponsored, endorsed or administered by, or associated with any manufacturer, third party (including any organisation associated with Another Way) or service provider of the relevant prize. You are providing your information to the Promoter and not to Another Way, or any manufacturer, third party or service provider of the relevant prize.
⁃ The Promoter reserves the right at any time to cancel, modify or supersede the Promotion (including altering prizes) if, in its sole discretion, the Promotion is not capable of being conducted for means beyond the Promoters control or where it becomes necessary to do so.
⁃ Participants are deemed to have accepted and agreed to be bound by these Terms And Conditions upon entry. Any participant who enters or attempts to enter the Promotion in a manner, which in the Promoter's reasonable opinion is contrary to or in breach of these Terms and Conditions or by its nature is unjust to other entrants (including tampering with the operation of the Promotion, cheating, hacking, deception or any other unfair playing practices such as intending to annoy, abuse, threaten or harass any other participants or the Promoter and/or any of its agents, employees or representatives) may be disqualified from the Promotion at the Promoter's sole discretion. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition. Furthermore, where such actions have significantly impaired the Promotion, the Promoter may, at its sole discretion, add further stages to the Promotion as it deems reasonably necessary in order to resolve any problems arising from such actions.
⁃ These Terms and Conditions are governed by English law. The courts of England and Wales shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Promotion or these Terms and Conditions.
⁃ The promoter of this Promotion is TOCA Social UK Limited, (a subsidiary of TOCA Football, Inc) with company number 12620358 of 240 High Holborn, London, WC1V 7DN (the Promoter).
Eligibility Requirements
⁃ By entering the contest, you confirm that you are eligible to claim the prize.
⁃ This competition is open to over 18s only.
⁃ The winner must have a valid passport & be fit to travel to Australia.
⁃ Entrants must be a resident of the United Kingdom and Republic of Ireland, except employees of the Promoter, their families, friends or any third party directly associated with administration of the competition / Promotion.
⁃ TOCA Social retains the right to ask you to provide proof of your identity should you be selected as the winner.
⁃ Entries automatically generated by a computer in bulk or by a bot will not be accepted.
⁃ Any illegible, altered, reconstructed, forged or tampered with or incomplete/false entries will not be accepted.
⁃ TOCA Social reserves all rights to disqualify any entrant or winner at any time if the conduct is contrary to the spirit or intention of the competition or the brand/reputation.
⁃ If there is any reason to believe that there has been a breach of these terms and conditions, TOCA Social, at its sole discretion, reserves the right to exclude you from participating in the contest and/or suspend or terminate the winner’s use of the prize.
